Terms and conditions

These Terms and Conditions (“Agreement”) govern the provision of vehicle graphics, signage, graphic design, and related services by Xcessive Graphics (“Company,” “we,” “us,” or “our”), a locally owned and operated graphics and sign supplier based in Okotoks, Alberta. By requesting a quote, placing an order, or engaging our services, you (“Client” or “you”) agree to be bound by this Agreement.

1. Company Information

Xcessive Graphics is a locally owned and operated vehicle graphics and sign supplier based in Okotoks, Alberta. With over 15 years of industry experience, we provide vehicle wraps, graphics, signage, decals, graphic design, and branding services to residential and commercial clients across Alberta, using premium products from industry-leading brands including 3M and Avery Dennison.

2. Services

2.1 Scope of Services

Xcessive Graphics provides the following services:

  • Full vehicle wraps and partial vehicle wraps
  • Vehicle graphics, decals, and lettering
  • Fleet graphics and fleet branding
  • Colour change wraps
  • Custom signage (indoor and outdoor)
  • Graphic design and brand identity development
  • Decals and custom stickers
  • Installation of graphics on vehicles of all sizes in our production and installation facility

2.2 Products

We use premium-grade vinyl and graphic materials from recognized brands including 3M and Avery Dennison. The appropriate product will be recommended based on your project requirements, intended use, and environment. Any material substitutions will be communicated to you prior to production.

2.3 Design Services

Custom graphic design services are available as part of a project or as a standalone service. Design work is subject to the terms in Section 8 (Intellectual Property). All design files remain the property of Xcessive Graphics unless otherwise agreed in writing.

3. Quotes and Pricing

3.1 Free Quotes. We provide free, no-obligation quotes for all projects. Quotes are valid for thirty (30) days from the date of issuance unless otherwise stated.

3.2 Quote Acceptance. A quote becomes binding upon written or electronic acceptance by the Client. Production will not begin until the quote has been accepted and any required deposit has been received.

3.3 Price Changes. If unforeseen complexities, material changes, or Client-requested scope changes arise after a quote is accepted, we will communicate the revised pricing in writing and obtain your approval before proceeding.

3.4 Rush Orders. Rush production or installation requests are subject to availability and may incur additional fees, which will be communicated at the time of booking.

4. Payment Terms

4.1 Deposit. A deposit may be required to commence design work and/or order materials. Deposit amounts will be specified in your quote. Deposits are non-refundable once materials have been ordered or design work has commenced.

4.2 Final Payment. The remaining balance is due upon project completion and prior to the release of finished goods or vehicle pick-up, unless otherwise agreed in writing.

4.3 Late Payment. Invoices not paid within thirty (30) days of the due date may be subject to a service charge of 2% per month (24% per annum) on the outstanding balance.

4.4 Disputed Invoices. Any billing disputes must be raised in writing within seven (7) days of receiving the invoice.

5. Client Responsibilities

To ensure the best possible result, the Client is responsible for:

  • Providing the vehicle or surface in a clean condition prior to installation. Vehicles must be free of wax, grease, and heavy dirt. Additional cleaning fees may apply for vehicles delivered in poor condition
  • Disclosing any known surface damage, rust, previous wraps, paint corrections, or non-standard paint (e.g., matte, ceramic coated, or aftermarket paint) prior to installation
  • Providing accurate vehicle details (make, model, year) when requesting a quote, as pricing is based on vehicle specifications
  • Providing accurate artwork files, brand guidelines, or sufficient creative direction for design projects
  • Reviewing and approving all design proofs in writing before production commences. Production errors resulting from Client-approved proofs are not covered under warranty
  • Picking up the vehicle or completed product within five (5) business days of notification of completion

6. Design Approval and Proofing

6.1 All custom design or print projects require written Client approval of a digital proof before production begins. Xcessive Graphics is not responsible for errors in content, colour, spelling, or layout that were present in and approved on the final proof.

6.2 Colour Accuracy. Digital proofs are representations of the final product and may vary slightly from the printed output due to differences between screen displays and physical print media. Xcessive Graphics will make reasonable efforts to match approved colours but cannot guarantee exact colour reproduction across all substrates.

6.3 Revision Rounds. Quotes include a reasonable number of design revision rounds as specified in the project agreement. Additional revision rounds beyond the included number may be billed at our standard hourly design rate.

7. Vehicle Condition and Surface Liability

7.1 Xcessive Graphics takes reasonable care during installation. However, we are not responsible for pre-existing damage to the vehicle or surface that becomes visible or worsens during or after wrap installation, including but not limited to paint chips, rust, dents, or low-quality paintwork.

7.2 Wrap removal may affect original paint, particularly on older vehicles, vehicles with repainted panels, non-factory paint, or paint that is already peeling or damaged. The Client acknowledges this risk and agrees that Xcessive Graphics is not liable for paint damage resulting from wrap removal on surfaces with pre-existing conditions.

7.3 We recommend that the Client disclose any paint protection film (PPF), ceramic coating, or custom paint finishes prior to installation, as these may affect adhesion and removal.

8. Warranty

8.1 Installation Warranty. Xcessive Graphics warrants the workmanship of our installations against defects in application, including lifting edges, bubbling, or peeling not caused by external factors. Warranty duration will be specified in the project agreement.

8.2 Material Warranty. Vinyl materials are subject to the manufacturer’s warranty (3M or Avery Dennison). We will assist Clients in processing material warranty claims where applicable.

8.3 Warranty Exclusions. Warranties do not cover:

  • Damage caused by improper vehicle washing (e.g., high-pressure automated car washes, abrasive cleaning products)
  • Damage from prolonged UV exposure, extreme weather conditions, or environmental contaminants
  • Damage caused by accidents, impacts, or third-party modifications after installation
  • Lifting or peeling caused by pre-existing surface conditions disclosed or undisclosed at the time of installation
  • Normal wear and tear over time

8.4 Warranty Claims. To submit a warranty claim, contact us using the information in Section 13.

9. Turnaround Times

Estimated turnaround times will be provided at the time of quoting and are subject to production workload, material availability, and Client approval timelines. Xcessive Graphics will make reasonable efforts to meet agreed timelines but is not liable for delays caused by material supply issues, Client delays in providing approvals, or other factors outside our control.

10. Vehicle Storage

Vehicles left on our premises for more than five (5) business days after notification of completion may be subject to a storage fee. Xcessive Graphics is not responsible for damage to vehicles left on our premises beyond the agreed pick-up timeframe. Vehicles left for more than thirty (30) days without communication may be treated as abandoned in accordance with applicable Alberta legislation.

11. Intellectual Property

11.1 Client-Supplied Artwork

The Client warrants that all logos, images, and artwork supplied to Xcessive Graphics are owned by the Client or that the Client has obtained all necessary rights and permissions for their commercial use. The Client accepts full responsibility for any intellectual property infringement arising from Client-supplied materials.

11.2 Xcessive Graphics Designs

All original graphic designs created by Xcessive Graphics remain the intellectual property of Xcessive Graphics unless a full transfer of ownership is agreed in writing and included in the project quote. The Client is granted a non-exclusive licence to use the final design for the purposes specified in the project. Xcessive Graphics reserves the right to display completed work in our portfolio and marketing materials unless the Client requests confidentiality in writing.

12. Accessibility Commitment (Accessible Canada Act)

Xcessive Graphics is committed to the principles of the Accessible Canada Act (S.C. 2019, c. 10), which aims to identify, remove, and prevent barriers for persons with disabilities across Canada. Our commitment includes:

  • Providing accessible formats of this Agreement and project documentation upon request (e.g., large print, plain language summaries)
  • Ensuring our website meets WCAG 2.1 AA accessibility standards to the extent practicable
  • Training our team to assist clients with disabilities throughout the inquiry, design, production, and pick-up process
  • Accommodating reasonable accessibility requests for individuals visiting our facility or engaging our services
  • Maintaining an accessible feedback process for clients to report accessibility barriers

13. Governing Law

These Terms and Conditions are governed by the laws of the Province of Alberta and the applicable federal laws of Canada. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30) days, disputes shall be resolved in the courts of Alberta.

14. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Updated terms will be posted on our website at xcessive.ca with a revised effective date. Your continued use of our services after changes are posted constitutes acceptance of the revised terms.
